Grand Juries: Purpose, Proceedings, and Influence

A grand jury is a body of citizens empowered to investigate potential criminal conduct and determine whether sufficient evidence exists to bring criminal charges, known as an indictment.

Unlike a trial jury (or petit jury), a grand jury does not determine guilt or innocence; its role is purely inquisitorial and accusatorial, deciding if there is probable cause to believe a crime has been committed.

In the United States, grand juries typically consist of 16 to 23 members and operate in secret.

During grand jury proceedings, the defendant is usually not present, and there is no defense attorney or judge in the room; only the prosecutor presents evidence.

A minimum of 12 votes are needed for an indictment to be issued.

FBI’s Arctic Frost Investigation

The FBI’s “Arctic Frost” investigation, launched in April 2022 , was initiated to investigate a “multifaceted conspiracy to overturn the results of the 2020 Presidential Election.”

This probe became the basis for Special Counsel Jack Smith’s elector case against former President Donald Trump.

High-ranking officials, including then-Attorney General Merrick Garland, Deputy Attorney General Lisa Monaco, and FBI Director Christopher Wray, personally approved the opening of this investigation.

The investigation involved the use of toll record analysis to track communications, targeting numerous Republican senators, and nearly 100 Republican-linked groups and individuals.

This included organizations like Turning Point USA and the Republican National Committee.

The investigation also involved the acquisition of government-issued cell phones belonging to former President Trump and former Vice President Mike Pence.

Perspectives

FBI’s Arctic Frost investigation was a politically motivated abuse of power.

  • Operation Arctic Frost was a government attack orchestrated by the “Deep State” or Biden administration, designed to target conservative figures and silence dissent regarding election integrity.

  • Former FBI Assistant Director Timothy Thibault, known for alleged anti-Trump bias, played a central role in obstructing congressional investigations and advancing Arctic Frost despite concerns about insufficient evidence, violating FBI rules.
