The Magnitsky Act is a U.S. law that empowers the U.S. government to impose sanctions on foreign individuals and entities involved in human rights abuses or significant acts of corruption globally.
Originally enacted in 2012 as the Sergei Magnitsky Rule of Law Accountability Act to target Russian officials, it was expanded in 2016 to worldwide applicability as the Global Magnitsky Human Rights Accountability Act.
The original Magnitsky Act, signed into law by President Barack Obama in 2012, was named after Sergei Magnitsky, a Ukrainian-born Russian lawyer who died in a Moscow prison in 2009.
Magnitsky's death followed his exposure of a $230 million tax fraud by Russian companies involving Russian tax officials. The initial act imposed economic sanctions on Russian officials deemed responsible for his death and other human rights abuses.
In 2016, the law was superseded by the Global Magnitsky Human Rights Accountability Act, expanding its scope beyond Russian nationals to individuals worldwide who engage in gross human rights violations or significant corruption.
This powerful legal instrument allows the U.S. government to deny sanctioned individuals entry into the U.S., seize any of their property held in the country, and effectively prevent them from engaging in transactions with a large number of banks and companies, including American firms and international firms with American subsidiaries.
The U.S. President has the authority to impose these sanctions on any foreign person determined, based on credible evidence, to be responsible for extrajudicial killings, torture, or other gross violations of internationally recognized human rights, especially against those who expose illegal government activity or seek to promote human rights and freedoms.
The Office of Foreign Assets Control (OFAC) within the U.S. Treasury Department issues guidance and licenses related to Global Magnitsky sanctions.
The Russian government responded to the original Magnitsky Act by prohibiting Americans from adopting Russian children, issuing its own list of sanctioned American officials, and posthumously convicting Magnitsky.
Beyond the U.S., other countries and regions have enacted similar Magnitsky-style legislation, including Canada, the UK, Estonia, Latvia, Lithuania, and Czechia, while the European Union has also worked towards a global sanctions regime.
The Global Magnitsky program is noted as one of the most active of these initiatives, targeting over 300 individuals and entities from 40 countries.
This Act affects not only the targeted person but anyone attempting to help or do business with this person, whether that help is from individuals, organizations, or governments - they will end up with the same restrictions as the targeted person.
In effect, when applied to an influential person in a government, even the country is affected, as most - both domestic and foreign - will distance themselves to avoid being inadvertently caught in a situation that appears to be they are assisting the targeted person.

Brazilian Congresswoman Carla Zambelli (PL-SP) turned herself in to Italian authorities while requesting political asylum and was promptly arrested pending review of her appeal
She is subject to a definitive arrest order issued on June 7 by Justice Alexandre de Moraes of the Brazilian Supreme Federal Court (STF), which mandated the immediate execution of a 10-year prison sentence, initially to be served in a closed regime.
The arrest followed after Italian MP Angelo Bonelli located the apartment where Zambelli was reportedly staying in Rome.
"Carla Zambelli is in an apartment in Rome. I provided the address to the police, and they are currently identifying Zambelli," Bonelli stated.
Recently, with the help of her husband, she had been negotiating with members of the Italian party Lega Nord to frame her case as judicial persecution by the Brazilian justice system.
However, the effort stalled due to diplomatic hurdles between the 2 countries and the recent visit of other Brazilian government officials to Rome.

Supreme Federal Court (STF) Justice Flávio Dino expressed support for fellow Justice Alexandre de Moraes after the United States government announced sanctions against him under the Magnitsky Act.
In a post on social media, Dino stated that Moraes is "simply doing his job" and cited a Bible verse:
"My personal solidarity to MINISTER ALEXANDRE DE MORAES.
He is simply doing his job, honestly and diligently, in accordance with the Constitution of Brazil.
And his decisions are reviewed and upheld by the proper COURT body (the Plenary or the 1st Panel of the STF).

A group of 16 Members of the European Parliament (MEPs) sent a letter to the European Union (EU) High Representative for Foreign Affairs and Security, Kaja Kallas, urging the bloc to impose sanctions on Brazilian Supreme Federal Court (STF) Justice Alexandre de Moraes and other members of the court
The initiative to send the letter came from Polish MEP Dominik Tarczynski, of the nationalist right-wing Law and Justice party.
“I write to urge you to propose that the Council of the European Union adopt targeted sanctions under the EU Global Human Rights Sanctions Regime against Brazilian Supreme Court Justice Alexandre de Moraes and his allies in the court, for their blatant violations of human rights and democratic principles. Since 2019, Justice Moraes has unilaterally assumed the roles of investigator, prosecutor, and judge, issuing secret orders to censor political speech, freeze assets, and imprison critics without due process.
“Now, Justice Moraes is overseeing the politicized prosecution of his main political opponent, former President Jair Bolsonaro, based on unfounded charges — seeking to sentence him to life in prison \[sic] and prevent him from running and winning the 2026 presidential elections in Brazil. Sadly, in today’s Brazil, an unelected judge is destroying democracy in the name of defending it. The EU must act before it’s too late.”

The exemptions imposed on Brazil by Donald Trump were malicious because:
They show that the Reciprocity Tariff Law approved in the Chamber of Deputies with the support of the Lula (PT) government is not automatic and depends on manual mechanisms, contrary to what the Brazilian government had stated.
If Lula retaliates, all exemptions will be lost.
It is a test to see if Lula’s statements about retaliating were true or just election bravado.
If he accepts the tariffs without negotiating and risks being the only country excluded from the relief measures, and with possible sanctions coming from NATO and the European Union, Lula will show weakness before his electorate.
If he refuses and forces retaliation, the exemptions will disappear, opening the door for tariffs above 75% up to 100%, worsening Brazil’s situation one year before the presidential elections.

Most are unaware Brazil already has a hefty import tariff in place, with a minimum of 160% and I have personally seen the tariffs above 3000% - none of this has been mentioned by either the Trump administration or the Lula administration.
The amount of the tariff is determined by the popularity of the product being imported - any foreign brand NOT produced and assembled within Brazil gets hit with this tariff.
For the Lula administration to say anything about this would be committing a death sentence, as then Trump all and most certainly will reconsider if the tariffs being implemented for Brazil are indeed too low.

“The trial of crimes that involve a serious attack on Brazilian democracy is under the exclusive jurisdiction of the country's judiciary, exercising its constitutional role independently.
There is an ongoing criminal action before the Court in which the Attorney General has charged a group of people, including a former President of the Republic, with a series of crimes, among them, the crime of attempting a coup d’état.

Attorney Martin de Luca mocked the actions of Brazil’s Office of the Attorney General (AGU) in response to the U.S. sanctions against Supreme Federal Court Justice Alexandre de Moraes.
De Luca represents the platforms Rumble and Trump Media in Brazil.
He shared the news about the AGU’s reaction and commented that “we will have to wait a long time.”
According to him, the agency has not even formally responded to the lawsuit filed by the companies he represents in U.S. courts.
If the AGU reaction will be as strong and proactive as their promises to appear in federal district court in Florida we will be waiting a long time.
It’s been 7 months that the AGU is vowing to defend Alexandre de Moraes in the federal case and yet the AGU or Alexandre are yet to appear.

A letter sent by Brazil’s Foreign Minister Mauro Vieira to U.S. Secretary of State Marco Rubio will remain classified for 15 years.
The decision was made by the government of President Luiz Inácio Lula da Silva (PT).
The move is based on the “secret” classification assigned by the Ministry of Foreign Affairs.
The document will only be publicly accessible starting November 25, 2039.
The Ministry justified the restriction under the Access to Information Law (Law 12.527), stating that disclosure of the content could “harm or jeopardize the conduct of negotiations or the country’s international relations, or involve information provided confidentially by other states or international organizations.”
According to diplomatic sources, Vieira sent the cable to Rubio in November 2024, intending to open a channel of dialogue with the Trump administration.
In the message, he congratulated Marco Rubio on his inauguration as head of U.S. diplomacy.
The letter, however, was not answered.

The third-largest party in Brazil's Chamber of Deputies, União Brasil (UB – centrist), will completely withdraw from President Luiz Inácio Lula da Silva’s (PT) governing coalition and expel any ministers who choose to remain in the administration.
Of the 3 ministers nominated by União Brasil, only Celso Sabino (Tourism) is officially affiliated with the party.
According to sources, he will be expelled from the party if he continues in the government as part of Lula’s personal quota.
With no support base in Congress, União Brasil's departure signals even greater difficulties for Lula's administration to pass measures that could support his reelection efforts.
The party holds 59 seats in the Chamber, making it the third-largest bloc, behind the PL (99 seats, opposition) and PT (67 seats, ruling party).
The party has decided not to prolong its involvement in the administration, given its stance against supporting Lula’s reelection in 2026.

Following a tense meeting with Brazilian President Luiz Inácio Lula da Silva (PT), Supreme Federal Court (STF) President Luís Roberto Barroso and Justice Gilmar Mendes spoke out in defense of Alexandre de Moraes during the reopening of the Court’s work after the Judiciary’s mid-year recess.
Both justices also defended Brazil’s sovereignty and made veiled criticisms of the United States and U.S. President Donald Trump, without mentioning them by name.
Gilmar and Barroso further stated that Moraes has endured “high personal costs” for serving as the rapporteur in the criminal case concerning the alleged coup attempt.
Barroso emphasized Moraes’ “dedication and courage,” affirming that the criminal proceedings related to the alleged coup “have been conducted with full respect for due process and transparency throughout all stages of the trial.”
Gilmar Mendes, meanwhile, delivered a harsher speech, criticizing allies of the former president and American big tech companies.
“It’s no secret that the attacks on our sovereignty have been fueled by radicals unwilling to accept the defeat of their political group in the last presidential election. Among them, a congressman \[Eduardo Bolsonaro] who, at the forefront of this betrayal, fled the country to cowardly spread slander against the Supreme Federal Court in a true act of treason,” he declared.
“To those who spread instability and chaos—irresponsible and cowardly individuals who call themselves patriots but openly work against their own country’s interests—there should be no doubt that the criminal acts committed against legitimate authorities and the Brazilian people will be met with a forceful response from the Brazilian State. These individuals are hostile to democracy, armed with the same radicalism, disinformation, and servility that have characterized their behavior for years now,” said Gilmar Mendes.

Supreme Federal Court (STF) Justice Alexandre de Moraes launched an attack against individuals allegedly involved in orchestrating sanctions against Brazil after being indicted or investigated in the criminal case concerning the alleged coup attempt following the 2022 elections.
“We have recently witnessed actions by several Brazilians who are either being prosecuted or investigated by the Office of the Prosecutor General (PGR) or the Federal Police for various willful and conscious acts as part of a true criminal organization which, in a manner never before seen in our country, acts cowardly and treacherously with the aim of subjecting the functioning of this Supreme Court to the scrutiny of a foreign state. They are fugitives, hiding outside national territory. They did not have the courage to remain in the country.
“These individuals, forming a crucial core group, operate through hostile and deceitful actions, born of spurious and criminal dealings, with the clear and obvious purpose of obstructing justice and of coercing this Court in its judgment of the criminal case [regarding the alleged coup attempt].
“In conduct typically associated with criminal militia members who attack authorities and their families, these actions by the criminal organization clearly constitute overt acts of treason against Brazil and explicit confessions of criminal activity. These false and illegal attacks against Brazilian authorities are aimed at provoking a serious economic crisis in Brazil—one which, to the dismay of these individuals, will not occur.”

Supreme Federal Court (STF) Justice Alexandre de Moraes stated this Friday that the Court will disregard all sanctions imposed by Donald Trump's administration against him and other justices of the Court.
According to the minister, the criminal proceedings related to the attempted coup in Brazil will continue without any external interference.
“The proceedings will continue. The procedural schedule of the Supreme Federal Court will neither be rushed nor delayed. The Court’s procedural routine will ignore the sanctions imposed. This rapporteur will ignore the sanctions and continue working, as I have been doing both in the Plenary and in the First Panel, always in a collegial manner, unlike the lies, falsehoods, and disinformation spread on social media. Due process at the Supreme Federal Court is always carried out collectively,” the minister emphasized.
He went on to say that the Court will try and conclude, in the 2nd half of this year, the criminal cases related to the 4 groups involved in the coup plot currently under the Court's jurisdiction.
Among the accused is former President Jair Bolsonaro.
“We will judge all those responsible—acquitting those for whom there is no evidence of responsibility, and convicting those for whom there is. But we will judge them, fulfilling our judicial duty, and we will not cower in the face of threats, whether they come from here or from anywhere else,” said the minister.

U.S. President Donald Trump has released the final list of tariffs that will be imposed on imports from dozens of countries within seven days. While Brazil was hit with a 50% surcharge, Argentina—whose current government is allied with the Republican president—will initially face a 10% rate
The administration of Javier Milei, which has been negotiating several agreements with Trump in recent months, secured the lowest percentage imposed by Washington so far.
A group of over 70 countries, including Brazil, was subjected to surcharges ranging from 15% to 50%.
According to the Argentine newspaper Clarín, which spoke with sources close to Milei, the Argentine government is continuing negotiations to obtain further benefits.
This week, the Casa Rosada hosted U.S. Secretary of Homeland Security Kristi Noem, who signed at least 2 key agreements with Argentina on behalf of Trump.
One of the agreements is in the area of security, and the other involves a letter of intent for Argentina to join the U.S. Visa Waiver Program, allowing Argentine citizens to enter the United States without going through the burdensome consular process.

U.S. Secretary of State Marco Rubio discovered that the letter he received from Brazil’s Foreign Minister Mauro Vieira is classified in its country of origin and commented that he may make it public within 7 days if deemed appropriate
Brazil’s Ministry of Foreign Affairs (Itamaraty) justified the restriction under the Access to Information Law (Law 12.527), stating that disclosing the content could “harm or jeopardize the conduct of negotiations or the country’s international relations, or involve information provided confidentially by other states or international organizations.”
Rubio remarked that such a law does not exist in the U.S., and since the document is on American soil, there would be no reason to keep it classified.

In an interview with Rádio Auriverde, Eduardo Tagliaferro, an expert and former top aide to Supreme Federal Court (STF) Justice Alexandre de Moraes at the Superior Electoral Court (TSE), stated that Moraes used the Electoral Court to harm the right wing during the 2022 elections
According to Tagliaferro, the election was marked by decisions that directly harmed the candidacy of then-president Jair Bolsonaro.
He cited as examples the ban on Bolsonaro’s campaign from using footage of the September 7th celebrations, Queen Elizabeth II’s funeral, and statements linking Lula to dictators.
“In my view, there was a persecution and a dismantling of the right’s image in the political arena during the 2022 elections. The right was stripped of its right to conduct a transparent campaign and to show its face.”
He also reported that the work of the Special Disinformation Response Unit (AEED), the department he was part of, was limited to producing reports based on requests received through WhatsApp groups.
These documents were forwarded to Moraes’s office, which was responsible for decisions.
“That’s how it worked,” he said. “Requests would come in: so-and-so, so-and-so, so-and-so. And over time, the targets were always the same,” he declared.
Tagliaferro stated he has more evidence against the justice and plans to compile it into a dossier to present to foreign authorities.
